Tinjauan Fiqh Muamalah dan UU Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen Atas Pesanan Di Konveksi Putra Fajar

Abstract


Humans as social beings need interaction with other humans to fulfill their life needs, one of which is by buying and selling economic transactions. The main needs that must be met include clothing, food, and shelter. In fulfilling the need for goods that do not yet exist or have not been produced, such as clothing, usually someone wants what suits their taste by ordering clothing experts, one of which is convection. In buying and selling transactions sometimes there are negligence. Based on Islamic law, if there is a production defect caused by the seller's negligence, the consumer has the right to continue or cancel the transaction which is called the right of khiyar. The government issued Law number 8 of 1999 concerning Consumer Protection to avoid the occurrence of forms of negligence for business actors. This study uses qualitative methods with primary data sources and secondary data. Data collection methods through observation, interviews, and documentation. The analysis used is descriptive analysis. The research results obtained are the buying and selling mechanism of Istishna' that occurs at the Putra Fajar Convection in accordance with Islamic teachings which fulfill the requirements and pillars and the process of ordering goods according to the concept of Istishna'. Meanwhile, liability for negligence of orders according to Law number 8 of 1999 concerning Consumer Protection carried out by Putra Fajar Convection has fulfilled its responsibilities as a convection owner.
