Abstract

The purpose of this study is (1) To determine the factors causing the cooperation carried out by PT. Radhia Mitra Sukses with home tailors, (2) To determine the application of the Ijarah contract to the cooperation agreement with the wage system carried out by PT. Radhia Mitra Sukses (Radhia Konveksi) with home tailors reviewed from the perspective of sharia agreement law. The method applied in this study is a qualitative method that is descriptive in nature. This means that in this study the researcher practices providing views and explaining a cooperation agreement with the wage system (Ijarah) of the convection business carried out in Kagulan Hamlet, Janti Village, Mojoagung District, Jombang Regency. The results of the study include, first, the cooperation agreement with the wage system of the convection business carried out by PT. Radhia Mitra Sukses and home tailors reviewed from the perspective of Sharia Economic Law is valid and has legal force because the pillars and requirements are complete. However, if there is a breach of contract, this agreement does not have legal force, because there is no physical evidence. Second, the practice of the convection business cooperation agreement between PT. Radhia Mitra Sukses and home tailors in Kagulan Hamlet, Janti Village, Mojoagung District, Jombang Regency, reviewed from the perspective of Sharia Economic Law during its implementation, the home tailors committed fraud by replacing the materials that had been agreed upon at the beginning, resulting in injury because there was a party that was harmed, namely PT. Radhia Mitra Sukses.
