Analisis Hukum Islam dan UU Nomor 13 Tahun 2003 Tentang Ketenagakerjaan Terhadap Pengupahan Berbasis Gender Pada Buruh Tani Padi di Desa Torbang, Kecamatan Batuan, Kabupaten Sumenep

Abstract


               One form of muamalah that is carried out daily is leasing. One example of leasing is the rental of farm laborers in Torbang Village, Batuan District, Sumenep Regency, where in practice there is inequality in determining wages between men and women. The purpose of this research is to find out the factors that cause differences in gender-based wage systems according to Islamic Law and Law Number 13 of 2003. The research used by researchers is qualitative research, namely descriptive field research. The results of this study indicate that the difference in the wages of rice farming workers between women and men is due to several factors, including: the majority of some workers say that because the energyexpendedby male farm workers is greater than that of female farm workers, the jobs given to male farm workers men are slightly different from female farm workers, etc. remuneration in Tobang Village is in accordance with the pillars and basis of remuneration in Islam. If differences in wages occur taking into account the factors that occur, then such wages are permissible in Islam. And in Law 13 of 2003 concerning employment it has been explained that there is no discrimination in wages, if the work is the same. As is the practice in the field, that there is a difference in the payment of wages in accordance with the work they receive taking into account the factors that occur and is not discrimination.
